CUSTOMERS INFORMATION EX ART. 13 GDPR

Dear Customer,

SWINGER INTERNATIONAL SPA ("SWINGER" or the "Company"), in its capacity as data controller, wishes to inform you that it needs to process the data you have provided as part of the contractual relationship or for the establishment of the same.

 

HOLDER OF THE TREATMENT

PURPOSE AND LEGAL BASIS OF PROCESSING

 

Personal data will be processed for the following purposes:

• Processing, management, fulfillment and any contractual, administrative, accounting and logistical activity related to the contractual relationship in place or to be established with the Owner, including all obligations required by law;

• Marketing, in order to inform you about events and offers, promotional sales and commercial communications.

The legal basis for processing a) is the execution of pre-contractual measures or a contract to which you are a party and the fulfilment of legal obligations, the legal basis for processing b) is your consent.

 

PERSONAL DATA RETENTION PERIOD

The data processed for the purpose a) will be kept for 10 years after the termination of the contractual relationship. The data processed for the purpose b) will be kept for 24 months.

 

CATEGORIES OF RECIPIENTS OF PERSONAL DATA

Without prejudice to the communications carried out in fulfilment of legal and contractual obligations, the data may be communicated exclusively for the purposes specified above to the following categories of recipients: professionals or administrative, accounting and tax service companies that carry out these activities on our behalf as data processors; credit institutions, transport and shipping companies, which carry out activities necessary for the provision of services and delivery of goods purchased; external structures, which deal with the technical and information management of our computer infrastructure; public financial administration; consultants of the Owner.

 

TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES AND ANY AUTOMATED DECISION-MAKING PROCESSES

The data controller may transfer your data outside the EEA when sending commercial communications, always ensuring an adequate level of security, in particular through the use of SCC. The Data Controller does not intend to use automated decision-making processes, including profiling.

 

NATURE OF THE CONFERMENT OF PERSONAL DATA

The conferment of your data for the purpose a) is compulsory and therefore the refusal to provide them in whole or in part will make it impossible for the company to establish or execute the contract or to properly carry out all the related obligations. The conferment for the purpose b) is optional and refusal will make it impossible for the owner to carry out marketing activities against you.

 

RIGHTS OF THE INTERESTED PARTY

You may exercise, where applicable, the rights provided for in Articles 15 et seq. of the GDPR (right of access, rectification, cancellation or restriction, opposition and portability of data). You also have the right to lodge a complaint with the Data Protection Authority or other competent authority.
